Approval of Contract Amendment for the Cost Increase to Contract No. C-100138 Plumbing On-call Maintenance and Services
Key Points
  1. An amendment to the current contract with Portland Mechanical Construction, LLC / JH Kelly for Plumbing Maintenance and Services is required to authorize cost increases to facilitate the continued maintenance on City facility plumbing systems.
  2. This contract includes the replacement of and/or the repair and rebuilding of plumbing systems as needed in City facilities.
  3. The City Water Department currently is requiring the immediate installation of Water Backflow Devices on all property water meters that currently do not have protection installed. Forty-three (43) City facility locations require backflow installations.
  4. With the contract amendment, Facilities proposes to contract with Portland Mechanical to install backflow devices at 20 locations (with an estimated cost of $355,629.41); the City Water Department will install the remaining 23 devices.
  5. The requested amendment to the contract requests sufficient funding to complete the backflow preventer project, as well as projected maintenance items between now and the end of the contract, which expires on September 27, 2023.

Present Situation
  1. On September 27, 2019, a four (4) year Contract C-100138 was awarded to Portland Mechanical Contractors, LLC for Plumbing On-Call services. The value of the original contract, together with amendments, was for a “not to exceed” cost of $300,000.00, which is under the threshold requirement for Council approval.
  2. Currently, Facilities has performed $259,005.83 in repairs on the City plumbing systems, only $40,994.17 remains on the contract.
  3. A City Water Department required major domestic water backflow preventer project is budgeted and assigned to be completed in the 2021-2022 biennium and potentially in 2023. This work is estimated to cost $355,630. This work will incur the remaining dollars on the contract as well as exceed the $300,000 limit of the Plumbing On-Call services contract. 
  4. The requested amendment to the contract requests sufficient funding to complete the backflow preventer project, as well as projected maintenance items between now and the end of the contract, which expires on September 27, 2023.
  5. The apprenticeship program only applies to public works construction projects. This contract is for on-call maintenance and the program does not apply. Furthermore, each separate task or request will be below the apprenticeship program threshold ($500k) and as an amendment to an existing contract, it is not possible to add substantial changes mid-contract.

Advantage(s)
Allows for the continued ability to perform necessary repair and replace, maintenance, or upgrades, as needed to the City's facility plumbing systems.  
Disadvantage(s)

Budget Impact
  1. The increase in the contract cap would allow the City to utilize the contact within the current budget authority.
  2. The required funds for repairs and upgrades are available through the Facilities and/or Capital Projects budget line items.

Action Requested

Approve a contract amendment for an increase of $500,000.00 for Contract No. C-100138 Plumbing On-call Maintenance and Services and authorize the City Manager, or their designee, to increase the total contract amount to $800,000 for the balance of the term of the contract.
